Just after you were given this task, your organisation suffers a major issue with a small contract. There have been a number of problems with a supplier of specialised cladding on a project to expand one of your specialist production facilities. It looks as though there are several “loopholes” in the contract formation process, as well as the contract itself, so this is going to be a trick one to resolve. You are relieved that it was not one of your contracts.
Your manager has asked that you include in your report recommendations for appropriate steps in the selection process to reduce the risk of similar contract-related problems in the future
You know from previous discussions that you manager believes that procurement professionals should be able to write good contracts in the majority of cases, and that specialist lawyers should not be involved unless their specialist skills are really needed. He will not be happy if you recommend that “legal write all our contracts and approve all the orders”, unless, of course, you can make a very good case in support of such as recommendation.
Notes:
Although your manager has only asked for recommendations, as an assignment you
should also show the basis for making these recommendations. You should describe the ideas and principles underlying any recommendations you make, show the alternatives
and ideas considered even if they are rejected, and as appropriate compare actual practices to good practice. You should demonstrate your broad business awareness in turning principles and ideas into workable processes and organisations, however a detailed assessment of change management and influencing is NOT required.
By “supplier selection process” we mean any process used to select a supplier of materials or services. For example if your organisation uses different processes to select materials supplier from that used to select services contractors, your answer should address both processes.
Completing this assignment successfully will mean that you have demonstrated that you have:
1. Been able to document and critically assess your own organisations process for selecting suppliers
2. Carried out a structured and thorough risk analysis of the selection process
3. Identified a range of risks and identified the highest priority risks and opportunities relating
to your supplier selection process
4. Identified, and clearly communicated, recommendations for improvement to a selection
process.
5. A good awareness of how legal risks can be managed during the supplier selection process.
