Problem question : The (fictitious) Council Housing Act 2016 (the Act) gives the power to the Chief Executive of all local authorities to “sell council owned property to council tenants who fulfil certain criteria”. The criteria include: 1. Tenancy must held their council tenancy for a minimum of 5 years 2. The tenant must have been a uk resident for 6 years 3. The tenant must have paid the rent regularly John is the Chief Executive of Limer Borough Council (the Council) and a member of the “Circus Party”. He has appointed a panel of five civil servants that work at the Council to be responsible for the decisions in accordance with the Act. In addition, the Council has a policy which provides that each applicant who fulfils the criteria will receive a £2,000 discount upon a successful application to buy their council house. Sarah has been a council tenant since 2004. Her neighbour (Coral) had been successful in her application to buy her council house, and she encouraged Sarah to apply to buy her council house. Sarah applied under the Act, but she did not receive any response from the Council. Three months after Sarah had applied, the Minister of Housing and Planning, who belongs to the “Circus Party” and who is worried about a forthcoming election, sends John an email to ask him to change the Council’s home selling policy. He wants John to restrict council house sales to council tenants who live in wards that are marked as “flagged”. A “flagged” ward is one where the two leading political parties (the “Circus Party” and the “Square Party”) each have a chance of winning in that particular ward. Surveys have shown that home owners tend to vote for the “Circus Party” whereas council tenants tend to vote for the “Square Party”. John made the necessary changes to the Council’s policy to restrict sales only to council tenants who live in one of the “flagged” wards. Nick has been a council tenant for seven years and he applied under the Act to buy his council house. His application was immediately refused because he does not live in one of the “flagged” wards Nick has found out about the real reason for the refusal and he has formed the “Buy your Council House Group” that campaigns to expose the Council’s policy. The Group has applied to the Police Chief of Limer for a permit to demonstrate but the application was turned down without giving any reasons.
