Neighbor removed all of my trees near the common boundary line. He excavated his property, changing the elevation so he could install a pool, which he did. He excavated his property along our common boundary line to make it 2'-6ft lower than before. He stacked rocks on my property where he sheared it off to hold the dirt, the rocks fall over when it rains and tree pieces and gravel also wash out of the wall. He regraded the entire part of my property near where he installed his pool so all of the water runs down my property, approximately 150 ft x 10 ft. He sheared off my property 6 -10 ft before the common boundary line and when I filed for a court hearing he put more and more rocks to fill up the area and covered them with dirt. The rocks keep falling over when it rains. The soil he put back was the consistency of sand, he recently put real soil on top of the sand. Yesterday he added bigger rocks to hold the wall with his backhoe, I believe the entire area is unstable, there are no drains and if you walk near the edge the rocks fall off and the ground cracks when you walk on it. Huge cracks in the soil appear, 20 ft or so, he keeps adding more soil and says the wall is fine he built it with a backhoe.
I have a surveyor who will mark the line next Wednesday, would like an engineer to come look at the property while the surveyor is here and assess the damage. The estimates to repair the damage are running around 130 K without the engineering cost or the property line fence I would like to install when we get the property repaired.
